Welcome to https://firstresponsecyber.co.nz (the “Site”), operated by The Shine Collective Ltd (“we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Site, and any purchases you make from us. By using the Site or placing an order, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Site.

1. About us
The Shine Collective Ltd  is a New Zealand based business selling digital products and related services through the Site. You can contact us at jacky@firstresponsecyber.co.nz and info@firstresponsecyber.co.nz.

2. Products and services
We sell digital products such as toolkits, guides, templates, and related materials. Some products may also include an in-person or online consultation, which is arranged separately by email or other agreed means.

We make reasonable efforts to ensure that product descriptions, images, and prices on the Site are accurate. However, we reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

3. Orders and payment
All prices are listed in New Zealand Dollars (NZD) and are inclusive of GST where applicable, unless otherwise stated.

When you place an order, you are making an offer to purchase the product at the listed price. Your order is accepted once payment is successfully processed and we send you an order confirmation by email.

Payments are processed securely through Stripe. By placing an order, you confirm that the payment details you provide are accurate and that you are authorised to use the payment method. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or unavailability.

4. Delivery of digital products
Once payment has been successfully processed, you will receive an order confirmation email containing access to your digital products (either as direct download links, attachments, or via your account on the Site).

It is your responsibility to download and save your purchased files within any applicable download period. We recommend downloading your files promptly and keeping a personal backup.

If you have any issues accessing your purchase, please contact us and we will do our best to assist.

For products that include an in-person meeting or consultation, arrangements will be made separately via email after your purchase.

5. Refunds and returns
Due to the nature of digital products, all sales are generally final and we do not offer refunds for change of mind or where you have already accessed or downloaded the product.

However, your rights under the Consumer Guarantees Act 1993 are not affected. If a product is faulty, does not match its description, or fails to do what we have said it will do, you may be entitled to a remedy. Please contact us as soon as possible and we will work with you to resolve the issue, which may include providing a replacement file, fixing the issue, or issuing a refund where appropriate.

6. Use of digital products
When you purchase a digital product from us, we grant you a non-exclusive, non-transferable, limited licence to use the product for your own personal or internal business use. Unless we expressly state otherwise:

  • You may not resell, sublicense, distribute, share, or upload the product to any third-party site or shared drive.
  • You may not reproduce the product for commercial resale or redistribution.
  • You may not remove or alter any copyright, trademark, or other proprietary notices.

All intellectual property rights in the digital products remain with us (or our licensors).

7. User accounts
If you create an account on the Site, you are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account. Please notify us immediately of any unauthorised use of your account.

8. Acceptable use
You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, or restrict the use of, the Site by any other person. In particular, you agree not to:

  • Use the Site in a way that is fraudulent, unlawful, or harmful.
  • Attempt to gain unauthorised access to the Site, its server, or any connected systems.
  • Interfere with or disrupt the Site or introduce any malicious code.

Copy, scrape, or reproduce any content from the Site except as permitted by these Terms.

9. Intellectual property
All content on the Site — including text, images, logos, branding, and digital products — is owned by us or our licensors and is protected by New Zealand and international copyright and trademark laws. You may not use any of this content without our prior written permission, except as expressly permitted by these Terms or applicable law.

The Site may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of those sites, and any visit to a third-party site is at your own risk.

11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the Site or our products.

Where we provide products or services to you in trade and you are acquiring them for the purposes of a business, the parties agree that the Consumer Guarantees Act 1993 and sections 9, 12A and 13 of the Fair Trading Act 1986 do not apply.

Nothing in these Terms is intended to limit or exclude any rights you have under the Consumer Guarantees Act 1993 or other consumer protection legislation that cannot be excluded by law.

These Terms are governed by the laws of New Zealand. Any disputes arising in connection with these Terms or your use of the Site will be subject to the exclusive jurisdiction of the New Zealand courts.
